OPT期间转换2016的h1b到新公司

很顺利有抽到h1b并且已经拿到H1b approval notice然後都交给新公司的律师
原本一切以为就等着PP的approval下来就可以正式离职了
但律师说移民局近年开始质疑在10/1前h1b尚未生效的h1b transfer申请
仍受cap限额限制（网路上已经有很多人在讨论这个部分，虽然说没有定见，但律师希望我保守点，說已經有很多被拒或被REF的案例）
所以律师说我如果一定得在10月1号前尽快上班 建议采用境外身份转换的方式
也就是在我10月1号至OPT EAD明年到期之前 回国一趟拿h1b签证。
说移民局是许可这样的转换案例。
但我听起来有点疑惑的原因是 我感觉境内境外转换只是多回国办签证一道手续而已
两者好像没有什麽不同...为什麽境外转换反而可以用EAD尽早上班？
不知道版大或是版友是否经历或是听过类似案例了
这个境外转换的选项是可行的吗？

The filing of a domestic conversion prior to 10/1 is not one of the options listed. It would have to be after 10/1 as noted below.[/align]
[align="left"]while the Consular Approval Approach will secure the coveted h1b cap number with my exit and re-entry with F-1 and then travel back to my home country to get h1b visa stamp?[LD] Correct. [/align]

律师还说 在9/30以前好像另外要出境一次 然後用F-1入境 的样子 是为什麽？
