OPT Update – Judge Vacates 17-Month STEM OPT as of February 2016, But New Rule on the Way

Earlier this month, I notified you that the U.S. District Court for the District of Columbia issued a

ecf.dcd.uscourts.gov[align="center"] that vacates the 2008 rule creating the 17-month extension for STEM OPT. The judge stayed vacating the rule until Feb. 12, 2016, in order to allow the Department of Homeland Security (DHS) to promulgate a new rule.[/align][align="center"]

The good news is that we have been diligently reaching out to all of the key players – including policymakers at the White House and DHS – and everyone we have talked to understands our concern that it is crucial they ensure there is no disruption for 17-month STEM OPT.

The schedule is tight to get a regulation done, but many government officials tell us it is doable. We are hearing the timing of a new rule will be as early as late September or early October, which would in all likelihood be followed by a 30- or 60-day comment period. If everything falls into place, a final rule could be issued by January. If necessary, the Department of Justice could also ask the judge to extend the stay vacating the STEM OPT rule beyond February 12 in order to get a rule done.

The new STEM OPT rule is unlikely to be a simple reintroduction of the 2008 STEM OPT rule. We are advocating that the new STEM OPT rule expand the STEM OPT extension beyond 17 months and that the extension be available for students with prior STEM degrees – for instance, an MBA with a bachelor’s degree in engineering. We are pressing officials to incorporate these changes in the new rule. The rule is also expected to tie OPT status more closely to a university course of study – a development we will be watching closely.

As regulatory and litigation processes continue, we will be a voice for employers and foreign national students who benefit immensely by gaining practical work experience in the United States after their course of study ends.[/align][align="center"]
