求救！F1被捕紀錄？！香港check

大家好，我的情況比較複雜。帖子比較長，麻煩你們了！！

我在2014年9月拿著b2(10年簽，秒過) 到了美國，10月的時候被美國警方逮捕，說我是identity theft. 我懵了，完全不知道發生什麼事情。當天被抓進去，打了指紋，拍了照片。本來第二天上庭，可是上庭之前，律師告訴我法院rejected the case due to lack of evidence. 就是法庭檢控官看完案件發現根本沒有證據，案件不成立，然後我拿回自己護照什麼的，就走了。

2015年2月，境內轉成F1，超級順利，上網填好資料遞交材料，7天後就收到i797. 一切都很順利。

但是兩週前，受到家裡消息，奶奶往生了，我要馬上回香港，因為是境內轉身分，所以要回來美國就一定要重新辦簽證。我9月23號飛機到香港，約了25號早上去面簽。

回去香港前，考慮到自己大打過指紋拍了照，不知道會不會影響簽證，特地打去諮詢律師，律師說應該沒問題，但是安全起見，還是給我準備了好幾份文件，一份是法院頒布的case rejection notice due to lack of evidence。

一份是律師說我這種案子不叫arrested,內容如下：

Dear 我的名字:

Please be advised that our office was retained to handle the matter related to your arrest on October 14, 2014. According to our records, you were arrested on that day in Los Angeles County by the xxx Department for one count of California Penal Code Section 530.5(a) (commonly known as "Identity Theft" charge). Booking number was xxxx. xxxx Police Department report number was xxxx.

On October 16, 2014, Los Angeles County District Attorney - xxxx Office informed us that your case was rejected due to lack of evidence. For your reference, the District Attorney Office number is xxxx. We thereafter obtained an official reject notice from the District Attorney's Office (please see the enclosed attachment).

According to California Penal Code Section 849.5, "in any case in which a person is arrested and released and no accusatory pleading is filed against him with an offense, the arrest shall not be deemed as arrest but a "detention only".

As I explained to you before, the law enforcement agencies might still have your fingerprint in files since you were booked, but you should not have any criminal record arising from this incident because you were never been charged nor convicted of any crimes.

Therefore, you should not have any problems as the U.S. Customs and Border Protection should allow you to return to California from Hong Kong on October 5, 2015.

I, the undersigned, am an attorney at law duly licensed to practice in the State of California. On October 14, 2014 我的名字 was arrested by the XXXX Police Department on a charge of Identity Theft. I was retained to represent him. On October 16, 2014 I learned that the prosecutor decided not to file any criminal charges against 我的名字 and the case was a D.A. reject.

On September 21, 2015 I personally went to the Clerk's office at the XXXX Superior Court and had the Clerk run 我的名字 to see if there is any record of a criminal filing and I was informed that a criminal case was never filed and there is no record of a criminal filing.

I declare under penalty that the foregoing is true. Executed on this 21st day of September, 2015 at Rosemead, California.

拿著這些文件，I20，學校老師允許我回去三週的文件，回程機票，學校文件，我25號上午8點就到了。然後就悲劇了。

他問我怎麼這個時候回來
我說奶奶過世了 然後把死亡證遞交 他完全沒看
他說了一句 i am so sorry 然後就拿著我的護照在電腦上打打打

然後他問我 為什麼你在DS160上說你沒有被arrested
我就說在填寫表格的時候 我以為上面填的是我從小在香港的紀錄
所以一開始就填了NO, 後來不確定就詢問律師，律師就說我這不是arrest, 是detention。

他聽完就說了一句，no it's not only for your record in Hong Kong. So have you been arrested?
我：I don't think i have been arrested, as my attorney had said, its a detention. 「把文件給他，他完全沒理我」
VO : (有點生氣了) Have you been arrested? This is about honesty.
我： 。。。。。 yes.

VO 這個時候才把律師信什麼的拿去看，看了好一陣子，看得出來是蠻認真在看的。
看完又在電腦面前打打打

打完後，就開始問我為什麼那個時候境內轉身分啊，上課學校怎麼樣啊，這次突然回來學業怎麼辦啊。。等等
這些部分都很順利 氣氛很愉快

只是結束的時候，他說了一句 We would need to get into an administrative process. That's why i can't issue you the visa now.

我懵了，那個時候完全不知道要幹嘛。一片空白。

他跟我要了護照，I20，律師信（我問他要不要我律師的名片，他反問我：Can i call them? 我說：Sure! 然後就把律師名片給他)

然後我就走了

到家才清醒點，發現自己沒有任何小紙條，他也沒說要process 多久，我自己又忘了問。但是我機票是十月五號要回去的，回去後馬上要考試，越想越不對，週五當天下午三點就上網填了那張visa inquiry form. 就是說我要趕回去考試，能不能給我個大概的processing time so i can discuss with my school and see how they can arrange the exams for me.

今天，中秋長假後的第一天，收到回覆：

Dear x x x,

Thank you for your inquiry. Your visa application is still undergoing necessary administrative processing. It is unfortunately impossible for us to predict the exact date when the processing will be complete. We will immediately inform you the result of the processing when it is completed. We understand the urgency of your case, but we must comply with the current visa processing procedures of the Department of State.

10/23 日，剛看到我passport location由 your passport is still with the consulate 變成 delivery information: 。馬上發郵件再去問，15分鐘後，有個女的打電話來，叫我週一下午兩點再過去，VO想見我。
