OPT extension期间从ICC换工作

背景： 我现在属于OPT extension期间，现在为一家ICC工作，想跳槽到一家full-time公司（E-verify，sponsor H1B）
我有两个问题
1. 我跟ICC签了工作合同，合同规定，我在合同期未满之前跳槽，需要付违约金，但是合同有个免责条款。我想知道我是否需要付违约金，合同内容是:"In view of the Employer’s expenditures in the
hiring, training, and other initial costs and efforts in the employment of the Employee, the Employee agrees to timely pay the Employer a compensation in the amount of Thirty thousand Dollars ($30,000.00) if the Employee resigns within 24 months of the starting date of the first client project. The employee should give ASK IT Consulting 30 days notice should he/she decides to termination employment with ASK IT Consulting at anytime. Employee will be exempt from the penalty and employment terms if he/she failed to obtain H1B visa sponsored by."
2. 如果我跳槽的话，是否需要从前任雇主带走任何证明我工作经历的文档给新任雇主？
