In-House Employment
The work location listed on the labor condition application indicates that the beneficiary will be performing services at your location. However, the record does not state the project to which the beneficiary will be assigned. Provide information to establish that your company has previously and continues to internally develop software or other tools of technology. In addition to showing the availability of specialty occupation work for the beneficiary, documentation submitted must establish that your company actively participates as a purveyor of development services in the software industry and should show how your services are promoted, evaluated and delivered to your clients.
Please submit documentation to establish the project the beneficiary will be assigned. USCIS requests that you provide a list of employees you have assigned or will assign to this project and that you show your company's progress on the specific project. Additionally, USCIS requests that you include updated timelines for anticipated or completed project deliverables, if applicable.
Provide evidence that you have specialty occupation work available for the requested H-1 B validity period. The following list contains suggested evidence that may be submitted. This list is not inclusive; you may submit other similar types of evidence that you feel will establish sufficient specialty occupation work.
; Copy of a position description or any other documentation that describes the skills required to perform the job offered, the tools needed to perform the job, the product to be developed or the service to be provided, the method of payment, whether the work to be performed is part of your regular business, the provision of employee benefits, and the tax treatment of the beneficiary by you;
; Copies of company brochures, pamphlets, Internet websites, or any other printed work published by you which outlines, in detail, the products or services provided by your company;
; Copies of critical reviews of your software in trade journals that describe the purpose of the software, its cost, and its ranking among similarly produced software;
; Copies of invoices supported by bank statements showing the sale of software products or services;
; Evidence of your company's expenditures on advertising for software products sold by your company;
; Contractual agreements with advertising companies who promote your software products;
; Copies of relevant portions of recent contracts, statements of work, work orders, service agreements, and letters between your company and the authorized officials of companies to which your product and/or services will be delivered and for which the beneficiary will be engaged in developing your product or rendering services during H- 1 B employment;
; Copies of relevant portions of recent contracts, statements of work, work orders, service agreements, and letters between your company and the authorized officials of companies to which your client's products and/or services will be delivered and for which the beneficiary will be engaged in developing your product or rendering services during H-1 B employment;
; Copies of relevant portions of recent contracts, statements of work, work orders, service agreements, and letters between your company and the authorized officials of companies to which your product and/or services have previously been delivered;
; Copies of relevant portions of recent contracts, statements of work, work orders, service agreements, and letters between your company and the authorized officials of companies to which your client's products and/or services have previously been delivered;
; Documentary evidence of payments made to your company by recent clients for products purchased and/or services delivered;
; Evidence of funding acquired for development;
; Documentation detailing any current or previous projects, which include business plans, designs, blueprints, media text, or photographs of prototypes (materials must clearly substantiate the author and date created and include evidence to clarify for what client or clients the project is intended to serve);
; Copy of the marketing analysis for your final software product; and/or
; Copy of a cost analysis for your products.
