change of employer 是否算 new petition (I129表填写问题)

information sheet 填好交上去，律师发过来了他填的I129表让核对信息。找出了好几个错误。。来来回回几次，感觉双方都烦了。。还有一个选项我还有疑问，律师一直也没回复给解释。。
Page 4 if 36m Part 4. 8. Did you indicate you were filing a new petition in Part 2?
律师填的是No.
然后8.a 也填了yes，然后再part 9 上写了我原有H1b的号。

请教大家一下，H1b transfer, Part 2 2. basis for classification 是change of employer，这里应该是filing a new petition么？
