H1B attorney fee + filing fee

最近在咨询H1B申请的事情，我联系的律师（小公司，没有in-house attoney）告诉老板：By law, it is the employer's responsibility to pay for the attorney fee and filing fee。老板听到“By law”后有些紧张，因为他既想让我支付attoney fee + filing fee，同时又不想承担可能涉及的legal risk。请问地里各位大神这位律师说的“By law”有依据吗？现实情况又是怎样的呢？万分感谢！
