H1B被拒，USCIS说打开后发现没有LCA，如何办？

各位前辈和朋友，大家好。小弟今天刚刚入地，遇到了H1B非常尴尬的悲剧原因，我的是master-cap,4/5由律师寄送申请材料到Vermont中心（non-pp）。一直等毫无消息，前天（6/17忍不住在uscis官网上咨询客服，提交了一个inquiry），昨天得到了如下回答：
The status of this service request is:
The petition will be returned to you for the following reason:
All H-1B cap-subject petitions received at the California or Vermont Service Centers from April 1, 2019 to April 5, 2019 were subject to a computer-generated random selection process ("lottery"). USCIS received your cap-subject H-1B petition during this filing period and your petition was selected towards the cap. However, upon review it has been determined that your petition was not properly filed. USCIS does not consider the petition to be properly filed for the reason(s) noted below. Therefore, USCIS has rejected the petition and is returning it to you. Please do not resubmit this petition as the H-1B cap for FY20 closed on April 5, 2019.
You did not include a Labor Condition Application (LCA) with your I-129 petition.
也就是说我竟然是被抽中了，我之前一直都在问学校问律师以及自己查看sevp portal,都没有任何变化，所以已经几乎放弃了。收到这个结果后，我立马联系了我的律师，他坚信自己是邮寄了LCA，并说自己有扫描的申请材料，所以要我去appeal,还需要付他费用2000美元以及填写某个I-1290B（名字记不清了）表格，费用又是六七百左右。现在很纠结需要怎么办？我也不确定是不是律师自己确实大意忘记了，还是怎么回事？现在怪他也是无济于事了。
请问大家有类似情况的吗？非常期待各位前辈的真心建议和帮助。之前都要放弃，准备明天再战了，结果又是抽中这么个无语的结果。心好累！希望抽中的盆友们都能顺利批准，遇到的都是负责任讲良心的律师。谢谢大家！

后续1：律师已经承认自己遗漏，表示全责在他，现在他同意免费继续appeal，所以我也只好静观其变。如果可万分之一的侥幸被批准，我就谢天谢地。否则，我会听从大家的建议去投诉他，截至目前为止没有提到任何赔偿
