关于H1b在美境内换护照后是否需要renew I-94的个人总结

最近因为疫情,回国非常困难,美加和美墨边境关闭,大家一定要注意可能的逾期滞留问题。我也是被美国海关弄的很迷糊,而且网上也是说法不一,所以决定研究清楚这个问题。 这里讲的主要是在美国境内换过护照是否必须出入境来renew electronic I-94上的admit until date的问题,希望对大家有帮助。

Case1:
After your last entrance: renewed I-797, renewed passport (It doesn’t matter which one happens first because when you file extension, they don’t require your passport)
you can ignore the electronic I-94 because your status is already extended and your passport is valid. Your actual “admitted to” date is the date on your new I-94 attached to the I-797
 
Case2:
After your last entrance: renewed passport
Have to re-enter to update the date on I-94 because otherwise CBP doesn’t know about your new passport. (Even if you tell them, they’ll most likely refuse to change the date.) Your actual “admitted to” date is the date on your electronic I-94, which is usually the expiration date (or 6 months before the expiration date) of your old passport.
 
Case3:
After your last entrance: renewed I-797
Refer to your “admitted to” date on your new I-94 attached to the I-797
