21名众议院议员写信支持OPT，要求优先解决国际学生签证问题

美国时间6月2日，众议院21名议员联名写信给美国国务卿Mike Pompeo和国土安全部代理部长Chad Wolf，要求他们保留OPT，并尽快解决签证问题，让国际学生今年秋季可以入学就读。


议员们指出：国际学生给美国每年带来410亿美元的收入，但2020年秋季，国际学生数目预计会锐减25%。

we urge your respective departments to communicate and share plans to address the expected increase in demand for visa services, including how U.S. consulates will be able to prioritize and process applications that include F-1 and J-1 visas. We believe several options are available to your agencies including the ability to waive certain interview requirements, prioritize the rescheduling of appointments that were canceled during COVID-19, and create a timely application and renewal process for professors, researchers, scientists, and those that are needed on U.S. campuses when instruction is expected to resume.

面对英国、加拿大、澳大利亚等国对吸引留学生的竞争，议员们希望美国政府能公开澄清：OPT不会有任何变化，从而吸引国际学生就读。

we urge the administration to publicly clarify that OPT will remain fully intact so we send the right messages abroad about the U.S. as an attractive destination for international
students. As countries like Canada, the United Kingdom, China and Australia bolster immigration policies to attract and retain international students, the last thing our nation should do in this area is make ourselves less competitive by weakening OPT. The program is essential to the many international students who desire not just to study in the U.S. but also have a post completion training experience.

## 目前写信表态的全是共和党议员

目前表过态的两院议员包括：

5月7日，4位参议院议员和8位众议院议员，共计12人，写信要求总统暂停移民签证，明确针对H1B和OPT。
5月27日，9位参议院议员，也写信给总统，要求他不要停止移民签证（H1-B、H2-B等）。
6月2日，21名众议院议员写信给国务院和国土安全部，要求保留OPT，并尽快解决签证问题让国际学生秋季赴美就读。

这些人全部来自于共和党。但目前并没有任何民主党议员公开写信表态。

总的来说，经过近期一系列的风波，我们对美国移民法有了更加深入的认知：

• 总统的权力主要就是一条：以损害美国利益为由，禁止外国人入境；
• 国务院有权力取消任何人的签证，但只能取消“入境许可”，无法取消合法入境者的境内身份；
• 国土安全部有权力绕过民众意见收集（公示阶段）、直接修改OPT，但是必然会被美国大学诉讼，重新拖回公示；
• 无论是谁，都无法直接取消H1-B工作签证，必须经过美国两院投票，H1-B很难被撼动；
• 即使只看共和党，其内部就移民/国际学生/OPT/H1B这些问题也存在重大分歧。
