急！OPT grace period 办h4 收到notice-LATE FILE

在网上和地里搜了一圈，好像没有发现类似的case:
我妹子在opt结束之后的grace period和我结婚拿证并且办了h4 交出h4的日子大概是opt结束之后的20天左右（在60天grace period）内，这快5个月了终于收到了feedback，给了一个rfe，其中一个是late file：

USCIS records indicate your authorized status expired on August 29, 2022. You filed this application
on September 20, 2022. Therefore, you were not in authorized status at the time of filing the
application.

咨询了一位律师表示grace period期间不可以转换h4？我没找到任何资料说grace period期间是not in authorized status啊。。。
不知道有没有朋友遇到过一样的问题，紧急求助！谢谢大家了！
