定了一个今年10月份的Disney邮轮,本来打算去加拿大首签H1b visa stamping,但是看到好多人都被check,所以就想看看能不能直接用AVR去做游轮。再网上看到有些人成功了,有些人也说不行。于是,发了邮件给CBP确认。 我发送的内容是描述了目前的身份,然后做邮轮会经过的岛屿。下面是CBP的回复,CBP的意思是不可以这样操作。

The adjacent islands travel is only for F or J visa holders. For H visa holders, the requirements for automatic visa revalidation are as follows:
Nonimmigrants with an expired visa may travel to Canada or Mexico and be re-admitted to the United States under the automatic visa revalidation (AVR) provision of law if the following criteria are met:
; The nonimmigrant’s stay in Canada or Mexico is 30 days or less;
; The nonimmigrant did not visit any other country other than Canada or Mexico;
; The nonimmigrant is in possession of their valid (unexpired) Form I-94 or extension of stay;
; The nonimmigrant is in possession of a valid (unexpired) passport, unless exempt;
; The nonimmigrant does not have a situation that requires a waiver of inadmissibility for criminal, security, or health related reasons
(Regulation from INA 212(d)(3));
; The nonimmigrant has not applied for a new visa while abroad;
; The nonimmigrant has maintained and intends to resume the same nonimmigrant status; and
; The nonimmigrant is not a citizen of a country designated by the United States as a State Sponsor of Terrorism. The list of countries can be found on the Department of State website at state.gov
